Ask the office that has the paper
This page is a map of custodians and the words to send them. It is not a filing. Nothing here has been mailed. A request is not a record, and a denial is not proof the record says what a rumor says.
Montana is not FOIA
Article II, section 9 is the right to examine documents and watch a public body work, unless individual privacy clearly outweighs disclosure. Section 8 is the right to a reasonable chance to participate before a final decision. Section 10 is the privacy right on the other side of both. The Legislature wrote the records rules in Title 2, chapter 6, and the meeting and participation rules in Title 2, chapter 3.
The federal Freedom of Information Act, 5 U.S.C. § 552, binds federal agencies. The state Office of Public Information Requests says FOIA does not control Montana records. Federal courts are not agencies either. A federal filing is a PACER problem, not a FOIA letter.
- Article II, section 9 · section 8 · MCA 2-6-1003
- Office of Public Information Requests — executive agencies on its list. Courts, cities, counties, the university system, and separately elected offices are not on that list.
- Department of Justice — its own portal only. The department says email, phone, mail, and a visit do not count.
Who to ask in Montana
Coroner and inquest
If an inquest is held, MCA 46-4-201 says the proceeding is public. The coroner also has a duty to keep inquiry records. Ask that county’s coroner for the inquiry file, the jury verdict, the recording, and a transcript only if one already exists. Do not ask the office to create one. The state medical examiner in Missoula or Billings holds autopsies a coroner sent in. That file is not the inquest. A death certificate is a vital record, and it is a different request.
Sheriff, police, jail
Initial arrest records and daily occupancy rosters are treated as public criminal justice information under MCA 44-5-301. Investigative files are confidential under 44-5-303 unless a criminal justice agency may have them or a district court finds that privacy does not clearly outweigh disclosure. A jail may also withhold security details under 2-6-1003. Ask for the policy and the log. Do not ask for a live roster of people in civil immigration custody.
Body cameras
Montana has no statute written only for body-worn cameras. Footage is requested as a public record or as criminal justice information, and agencies treat much of it as investigative. A private security company, including an off-duty officer on a private post, is not a public body. Its camera is a public record only if a city, county, or state office actually has the file. Say which office, which date, and which call. The GAO camera note is national: a retention period is not proof a tape exists.
Meetings, before the vote
Section 8 is participation, not a second records law. Agendas already posted by Missoula and the county are on the meetings desk. To speak, use the city’s or county’s own comment rules. Watching a meeting does not make you a party to a case.
Coroner file — copy, fill the blanks, send it yourself
Public information request
To the coroner, ________ County, Montana
Under Article II, section 9 of the Montana Constitution and Title 2, chapter 6, MCA, I ask to examine and copy the existing records of your inquiry into the death of ________ on ________ at ________.
Please include the determination of cause and manner, any inquest jury verdict, any witness list, and any recording or transcript that already exists. I am not asking you to create a transcript.
If you withhold a portion, name the statute and describe what was withheld. This is not a request for a jail roster or for confidential information about a living person.
ICE, JPATS, and the airports next door
The working file is still Montana. Washington, Idaho, North Dakota, South Dakota, and Wyoming matter because a person can be booked in one state and moved through another. No source below is a 2026 Montana custody flight.
- King County, Boeing Field. A county airport log, posted about weekly, for that field only. The county says it does not always get notice and will not guarantee a third party’s information.
- ICE FOIA for a named jail agreement, a named airport’s fee letters, or a camera policy. Not for a list of detainees.
- U.S. Marshals FOIA for a described JPATS record. The Service says it will not do research, answer a question, or create a record. A current schedule is not a FOIA category this desk will write.
- ICE Flight Monitor is Human Rights First’s advocacy count, built from public aviation data. It is the series behind the Ohio story. It is not an ICE manifest, and this desk does not copy its routes.
Left off on purpose: live ADS-B, call signs, and predicted-flight maps. Those are operational. The federal docket already holds the Ohio fee dispute, the two unverified airport awards, and the 2006 Montana request counts.
ICE — a named facility or airport, not a roster
Freedom of Information Act request
U.S. Immigration and Customs Enforcement
For ________ (jail or airport) from ________ through the date you search, I request:
1. The intergovernmental service agreement and its amendments, if ICE uses that jail.
2. Correspondence with that airport about landing fees, invoices, credits, or the February 2026 contractor waiver.
3. The written body-worn camera rule for detainee transport, and any aggregate count of how many transport recordings were kept or destroyed. Not the video, and not the names.
I am not requesting a list of people in custody. Please release the portions that are not exempt.
Marshals — the two award IDs, and the old Montana counts
Freedom of Information Act request
United States Marshals Service, Office of the General Counsel
1. Records showing whether award 15M10426PA3700004 (Lafayette Airport Commission, $27,011) and award 15M10426PA3700005 (Vector Airport Systems, $15,435) were funding-only actions on October 8, 2026, and any invoice showing a service was performed.
2. Non-federal JPATS billing summaries for fiscal years 2004 and 2005 in which Montana is the requesting jurisdiction, matching Appendix IV of DOJ OIG Audit 07-01.
I am not requesting a manifest, a tail number, or a current schedule.
Epstein records are federal, and already partly public
This desk has not found a Montana sheriff, jail, or coroner file about Jeffrey Epstein. Do not send a county a letter that assumes one exists. A Montana denial of that letter would mean the county does not have it, not that a federal file is empty.
- Already posted, without a new request: the FBI Vault collection. The Bureau’s own index also lists later parts titled “Records regarding the review of the Investigative Holdings related to Jeffrey Epstein.” Those are processed releases. They are not the whole file, and the Vault says older processing may not meet today’s standard.
- Court filings are not FOIA. They are requested from the court that has the docket, or read if someone has already placed them in the RECAP archive. This desk does not log into PACER and does not reprint a sealed name or a photograph.
- A further agency request goes to the FBI eFOIA portal, describing the record. The FBI does not have to investigate, summarize, or search a Montana office for you.
Nothing in that federal file is a finding about a Montana death, an ICE flight, or a local lawsuit. Those stay in their own dockets.
FBI — only what the Vault has not already posted
Freedom of Information Act request
Federal Bureau of Investigation
I request FBI records indexed under Jeffrey Epstein, and under the 2026 review titled “Records regarding the review of the Investigative Holdings related to Jeffrey Epstein,” that are not already posted in the Vault, for ________ through the date you search.
I am not asking the FBI to open an investigation, to summarize the file, or to search a Montana sheriff or coroner. If the record is a court filing, I will ask the court.
The five neighbors, each under its own statute
Same discipline. Name the office, the date, and the record. Do not add a neighbor’s jail count to a Montana death.
Washington
Public Records Act, RCW 42.56Boeing Field’s ICE log is a King County record under that act. It is not a statewide flight list.
Idaho
Public Records Act, Title 74Ask the county sheriff or the state police that holds the record. Title 74 is not Montana’s Title 2.
North Dakota
Article XI, section 6, and Century Code 44-04The Attorney General’s 2026 manual. A request need not say why. An opinion request has a 30-day clock.
South Dakota
Codified Laws, chapter 1-27Ask the political subdivision that has the document. There is no shared Northern Plains portal.
Wyoming
Public Records Act, Title 16, chapter 4The custodian is the agency. A request to Cheyenne does not reach a county coroner.
